1. Agreement to Terms

By accessing or using DivorceAssist ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and DivorceAssist("we," "our," or "us"). Please read them carefully.

2. Description of Service

DivorceAssist is a financial planning platform designed to help users organize, analyze, and calculate financial aspects of divorce proceedings. The Service provides:

  • Asset and liability tracking and organization
  • Income and expense analysis
  • Child support and spousal support calculations
  • Property division analysis
  • Document generation and reporting
  • Collaboration tools for working with professionals

Not Legal or Financial Advice

DivorceAssist is a calculation and organizational tool only. The Service does not provide legal, tax, or financial advice. All calculations are estimates based on the information you provide and publicly available guidelines.

  • Calculations may not reflect your actual court-ordered obligations
  • Support guidelines vary by jurisdiction and are subject to judicial discretion
  • Tax implications are estimates and should be verified by a tax professional
  • Property valuations are based on user-provided data, not professional appraisals
  • You should always consult with qualified legal and financial professionals

4. Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

We may suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

5. Subscription and Payments

5.1 Subscription Plans

We offer various subscription tiers (Free, Basic, Professional, Premium) with different features and limits. Current pricing and features are displayed on our pricing page.

5.2 Billing

  • Paid subscriptions are billed in advance on a monthly or annual basis
  • Payment is processed through Stripe, a PCI-compliant payment processor
  • You authorize us to charge your payment method for recurring fees
  • Prices may change with 30 days' notice

5.3 Cancellation and Refunds

  • You may cancel your subscription at any time through Account Settings
  • Cancellation takes effect at the end of your current billing period
  • We generally do not provide refunds for partial billing periods
  • Refund requests may be considered on a case-by-case basis

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Enter false or misleading information
  • Attempt to access other users' accounts or data
  • Interfere with or disrupt the Service
  • Reverse engineer or attempt to extract source code
  • Use automated systems to access the Service without permission
  • Resell or redistribute the Service without authorization
  • Use the Service to harm, threaten, or harass others

7. Your Data

7.1 Ownership

You retain ownership of all data you enter into the Service. By using the Service, you grant us a limited license to store, process, and display your data solely to provide the Service to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIVORCEASSIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • Errors in calculations or analysis
  • Decisions made based on Service outputs
  • Court outcomes or legal consequences
  • Service interruptions or data loss

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CALCULATIONS WILL BE ACCURATE FOR YOUR SPECIFIC SITUATION.

12. Indemnification

You agree to indemnify and hold harmless DivorceAssist, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Dispute Resolution

13.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at support@divorceassist.com to attempt informal resolution.

13.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to participate in class actions.

13.3 Governing Law

These Terms shall be governed by the laws of the State of [Your State], without regard to conflict of law principles.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
